When you visit our website and use our services, you trust us with your personal information. We take your privacy very seriously. In this privacy statement, we aim to explain to you in the clearest possible way what information we collect, how we use it, and what rights you have in this regard. We hope you’ll take the time to read it carefully, as it’s important. If there are any terms in this privacy notice that you don’t agree with, please stop using our apps and services, or contact us at the email address provided above.

This Privacy Notice applies to all information collected through our mobile applications (“Apps”) and/or any related services, sales, marketing, or events (collectively, we refer to them in this Privacy Notice as the “Services”).
Please read this Privacy Statement carefully, as it will help you make informed decisions about sharing your personal information with us.

General conditions of use of the DreaminzZz website

ARTICLE 1: Purpose

The purpose of these “general conditions of use” is to provide a legal framework for the use of the DreaminzZz.com and app.ulyapp.com websites and its services.

This contract is concluded between:

The manager of the website, hereinafter referred to as “the Publisher”,

Any natural or legal person wishing to access the site and its services, hereinafter referred to as “the User”.

The general conditions of use must be accepted by all Users, and their access to the site constitutes acceptance of these conditions.

ARTICLE 2: Legal notices

The websites app.ulyapp.com and dreaminzzz.com are published by the company DreaminzZz, SAS with capital of €1,093, whose head office is located at 1589 Avenue des vertes rives 84140 Montfavet.

The company is represented by Guillaume Gautier, Chairman and CEO.

ARTICLE 3: Access to services

The User of the DreaminzZz.com and app.ulyapp.com sites has access to the following services:

• Provision of a sales platform for additional content usable in the application called HYPNOS.
• Provision of a coaching and support system to help you achieve your personal goals.
• Provision of audio hypnosis sessions recorded by practitioners

Any User with internet access can access the site free of charge and from anywhere. The costs incurred by the User to access it (internet connection, computer equipment, etc.) are not the responsibility of the Publisher.

The following services are only accessible to the User if he is a member of the site (i.e. he is identified using his login details):
• Audio sessions and online product and service catalogs.
• Analysis and advice on the use of audio sessions.

The site and its various services may be interrupted or suspended by the Publisher, in particular during maintenance, without obligation to provide notice or justification.

In order to access the Site’s services and subscribe to the corresponding subscriptions (as described below), you must first create an account via the application by completing the registration form where you will include, according to the instructions requested and in the fields provided for this purpose, the mandatory information for your registration to be taken into account, namely in particular a valid e-mail address, by choosing a password and then by validating your registration.

On subsequent visits, you will be able to access the services by entering your email address and password as recorded during your registration.

In case you forget your password, you have a function to reset it.

Each user can only create one account. If we deactivate your account, you will not attempt to create another one without our permission.

3.1. Services

Once you create your account, you become a member of our application, which gives you access to certain sections, features, and functions of our application that are not available to non-members. You may also agree to receive emails regarding occasional special offers, marketing communications, communications related to your user lifecycle, and messages of a technical or quality-of-service nature from our platform. You can easily unsubscribe from these emails by following the opt-out instructions in these emails. Memberships and subscriptions to our Services are non-transferable and therefore cannot be sold, traded, or transferred in any way. The services you can access as a member include, but are not limited to:

a) Free programs and sessions.

The Site offers any user who has previously created an account an audio session broadcasting service including 4 support programs and several audio sessions.

b) “Premium” Access

Any Member may also access a paid subscription service that provides access to all content, including and beyond free trial sessions. All subscription services provide access to the Apps. You may become a Subscriber by purchasing a subscription to the Services within the Apps, where permitted by Appstore partners.

DreaminzZz offers four types of subscription:

1. a monthly subscription, renewable by tacit agreement for an identical period unless terminated in accordance with the terms of these Conditions,
2. a semi-annual subscription, renewable by tacit agreement for an identical period unless terminated in accordance with the terms of these Conditions, payable in a single payment upon subscription to the subscription
3. an annual Premium subscription, automatically renewable for an identical period unless terminated in accordance with the terms of these Conditions, payable in a single payment when subscribing to the subscription

For the purposes of our monthly, semi-annual and annual subscriptions, a month is made up of 30 calendar days, 6 months is made up of 182 days, a year is made up of 365 days.

Your right to access the Services is not transferable;

DreaminzZz also offers access to the service via gift cards:

• A gift card is billed and paid for in one payment at the time of purchase, and does not automatically renew.
• After payment, the buyer accesses their printable gift card (in PDF format) on the website or by email.
• Subscription period: The recipient becomes a Subscriber for the subscription period indicated on the gift card, starting from the date the recipient activates the card. To activate, the recipient must enter the gift card number in their member account.
• Each card is associated with a unique user account, declared upon activation, and cannot be transmitted or transferred subsequently. Its use is the sole responsibility of the gift card holder.
• No refund is possible after activation of the code on the gift card.
• Validity period: The validity period of gift cards is 6 to 12 months from the date of issue of the card.
• Period of use: The gift card can be used after a period of 12 (twelve) months following receipt thereof.
• The buyer confirms having verified that the beneficiary can actually access the service (appropriate version of smartphone, tablet, computer, operating system, browser, or app)

In order to subscribe to the above-mentioned subscriptions, or to purchase a gift card, the user must choose the chosen formula (monthly, semi-annual, annual subscription, gift card), and fill in the mandatory fields of the form accessible in the apps, accept these Conditions and validate their order by clicking on the “VALIDATE AND PAY” button.

Our obligation to provide you with this premium service (excluding gift cards) only begins when we have received confirmation of payment for your order and have confirmed your purchase by email. We will confirm your order when it is placed and confirm by email that you have access to the service in accordance with the purchased subscription. Please include your order number in all subsequent correspondence with us.
Prices in euros include VAT unless otherwise stated.
We may at any time and from time to time, at our sole discretion, change the amounts of subscriptions, fees, and taxes, or add new subscriptions, fees, and taxes in connection with any of our services. We will notify you by email at least 30 (thirty) calendar days prior to any change. If you do not accept the change, you can cancel your subscription in your account settings or by emailing support@dreaminzzz.com.

3.2. Guarantees

By creating an account on the Application and using the Services, you certify, guarantee and undertake that:

• the information you provide is personal to you, is accurate and that you do not use the personal information of others without permission,
• you are legally capable of entering into legal commitments;
• you are at least 13 years old and if under 18 years old (or the age of majority under the law applicable to you), you create your account and engage under the direction, supervision and with the consent of your legal representatives;
• Your personal information will be updated as necessary.

Article 4: Payments

4.1. Payment methods

On iOS mobile devices or tablets, the payment method offered is Apple iTunes. On Android mobile devices or tablets, the payment method offered is Google Play Store Pay. It is specified that when the user provides DreaminzZz with their bank details, these details are not stored by DreaminzZz.
To optimize transaction security, DreaminzZz has chosen the payment systems of iTunes (Apple) for iOS mobile devices and the Play Store (Google) for Android mobile devices. The guarantees provided by DreaminzZz regarding transaction security are identical to those obtained by DreaminzZz from the publishers of the aforementioned payment systems.

In the absence of evidence to the contrary provided by the Subscriber, the computerized records, stored in the computer systems of DreaminzZz and its partners under reasonable security conditions, will be considered as proof of communications, orders, validations and payments between the Subscriber and DreaminzZz.

4.2. Payment terms

• Monthly Subscription: Monthly subscriptions are payable by monthly recurring direct debit to the chosen payment method. The first payment will be made in advance when subscribing to the subscription and then each month, by direct debit to the payment method provided until cancellation of the subscription, whether the cancellation is at its initiative or that of DreaminzZz.
• Semi-annual subscription: Semi-annual subscriptions are payable by recurring semi-annual direct debit to the chosen payment method. The first payment will be made in advance when subscribing to the subscription and then on each anniversary date of the subscription, by direct debit to the payment method provided until cancellation of the subscription, whether the cancellation is at its initiative or that of DreaminzZz
• Annual Subscription: Annual subscriptions are payable by annual recurring direct debit to the chosen payment method. The first payment will be made in advance when subscribing to the subscription and then on each anniversary date of the subscription, by direct debit to the payment method provided until the subscription is terminated, whether the termination is at its initiative or that of DreaminzZz
• Gift Card: In the case of a single purchase without a subscription (gift card of a certain duration: 6 months, 1 year, etc.), the buyer agrees to pay the full amount when ordering.

No partial reimbursement (corresponding to part of the period) will be permitted in the event of unilateral termination without reason during the period.

4.3. Direct debit authorization

Except for gift cards, you authorize DreaminzZz and the relevant payment provider to debit the same payment method used for the initial subscription upon applicable subscription renewals. In the event of automatic renewal, the rate then in effect on the renewal date for the relevant subscription will be fully applicable. You agree to promptly notify DreaminzZz of any modification or change in the payment method you have provided, as pending this, all subscriptions will be suspended. You are responsible for all applicable fees, including applicable taxes, and for all subscriptions you have purchased. In the event that we are unable to collect the amount of your subscription on the agreed due date, you will nevertheless remain liable for the previous instalments and we reserve all rights and actions in this regard.

Article 5: Complaint, termination and right of withdrawal

5.1. Complaint

5.2. Termination by you

You can cancel your monthly, semi-annual, or annual subscription at any time by accessing your account settings from within the app. Cancellation will be effective at the end of the current monthly, semi-annual, or annual period.

5.3. Termination by us

We may suspend or terminate, without notice or recourse to the Courts, your use of our services following fraud or breach of any obligation arising from these Terms, including without limitation, failure to collect the amount of your subscription when due, unauthorized copying or downloading of our audio or video content from the Site or apps or any violation of the limited use license that we grant you in connection with your access to our services.

5.4. Right of withdrawal

In accordance with the provisions of Articles L. 222-9. Et seq. of the French Consumer Code, you acknowledge that the provision of services begins upon receipt of the email confirming your order and that you cannot exercise your right of withdrawal once the services have been fully provided to you. You have a withdrawal period of 14 (fourteen) calendar days from the date on which we begin to provide you with the services to withdraw without having to justify your decision or incurring additional costs in respect of services whose execution has not begun on the day your right of withdrawal is exercised. You will be reimbursed for the amount of your order to the payment method indicated when you placed your order (unless you instruct us otherwise). This reimbursement will be made within a maximum of 14 (fourteen) days from the day we are informed of the exercise of your right of withdrawal. You can exercise your right of withdrawal by sending an email to support@dreaminzzz.com

ARTICLE 6: User Responsibility

The User is responsible for the risks associated with the use of his/her login ID and password.

The User’s password must remain secret. The Publisher declines all responsibility in the event of password disclosure.

The User assumes full responsibility for the use he makes of the information and content present on the sites app.ulyapp.com and dreaminzzz.com.

Any use of the service by the User which directly or indirectly results in damage must be subject to compensation for the benefit of the site.

The member undertakes to make comments that are respectful of others and the law and accepts that these publications may be moderated or refused by the Editor, without obligation to provide justification.

By publishing on the site, the User grants the publishing company the non-exclusive and free right to represent, reproduce, adapt, modify, broadcast and distribute its publication, directly or through an authorized third party.

The Publisher, however, undertakes to cite the member in the event of use of his publication.

ARTICLE 7: Responsibility of the Publisher

The Publisher cannot be held liable for any server or network malfunction.

Likewise, the site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.

The dreaminzzz.com and app.ulyapp.com websites are committed to implementing all necessary measures to ensure the security and confidentiality of data. However, they do not provide a guarantee of total security.

The Publisher reserves the right not to guarantee the reliability of the sources, although the information published on the site is deemed reliable.

ARTICLE 8: Intellectual property

The contents of the dreaminzzz.com and app.ulyapp.com websites (logos, texts, graphic elements, videos, etc.) are protected by copyright, under the Intellectual Property Code.

The User must obtain authorization from the site publisher before any reproduction, copying or publication of these different contents.

These may be used by users for private purposes; any commercial use is prohibited.

The User is entirely responsible for any content he puts online and undertakes not to harm a third party.

The Publisher of the site reserves the right to freely moderate or delete content posted online by users at any time, without justification.

ARTICLE 9: Personal data

The User must provide personal information to register on the site.

The user’s electronic address (e-mail) may be used in particular by the dreaminzzz.com and app.ulyapp.com websites for the communication of various information and account management.

DreaminzZz guarantees respect for the user’s privacy, in accordance with law n°78-17 of January 6, 1978 relating to information technology, files and freedoms.

The site is registered with the CNIL under the following number: 2135198.

Pursuant to Articles 39 and 40 of the law dated January 6, 1978, the User has the right to access, rectify, delete and oppose the use of his or her personal data. The User exercises this right via the contact form available here: https://www.dreaminzzz.com/fr/contact/

ARTICLE 10: Hypertext links

The domains to which the hypertext links on the site lead do not engage the responsibility of the Editor of dreaminzzz.com and app.ulyapp.com who has no control over these links.

It is possible for a third party to create a link to a page of dreaminzzz.com without express authorization from the publisher.

ARTICLE 11: Changes to the general conditions of use

The dreaminzzz.com and app.ulyapp.com websites reserve the right to modify the clauses of these general conditions of use at any time and without justification.

ARTICLE 12: Duration of the contract

The duration of this contract is indefinite. The contract takes effect with respect to the User from the start of use of the service.

ARTICLE 13: Applicable law and competent jurisdiction

This contract is governed by French law.
In the event of a dispute not resolved amicably between the User and the Publisher, the courts of Avignon shall have jurisdiction to settle the dispute.
